Terms of Service
Last updated: October 12, 2026
The short version. Send a Smile writes your cards by pen and mails them for you. You pay for each card when it's sent. Be kind: only send cards you'd be happy to sign, to people you have a reason to write to. If something goes wrong with a card on our side, we'll make it right.
1. These terms
These terms are an agreement between you and KRK Communications Incorporated, doing business as KRK Strategic Communications ("we", "us"), 1506 Berwick Road, Ruxton, Maryland 21204, for your use of Send a Smile: the website at sendasmile.ai and app.sendasmile.ai, and the Send a Smile app for iPhone and Android (together, "the service"). By creating an account or using the service, you agree to them. Our Privacy Policy explains how we handle your information.
2. Your account
- You must be 18 or older and give accurate information, including your name and return address.
- Keep your password private. You're responsible for what happens in your account; tell us straight away if you think someone else has used it.
- You can delete your account at any time in Account › Delete my account.
3. Sending cards
- When you send a card, we print the design, write your message by pen (by a handwriting machine), address and stamp the envelope, and mail it with the postal service. Photos you add are printed and tucked in.
- Delivery times are estimates. Once a card is mailed, its delivery is in the postal service's hands.
- Check names, addresses and messages before you send: we print and mail what you give us. Previews show how a card will look, but handwriting and printing vary a little from what's on screen.
- A card can't be changed or cancelled once it's being written.
- Reminders send cards for you on the dates you set, and charge your saved payment card when each one mails. We'll tell you a few days before, so you can review it or skip it. Turning a reminder off, or deleting it, stops future cards.
4. Prices and payment
- Prices are shown before you send, including any extra for an artist's design or photos. You're charged when a card is sent, or, for a reminder, when it mails.
- Payments are processed by Stripe. You authorise us to charge your chosen payment method for the cards you send and the reminders you set up.
- We may change prices; changes apply to cards sent after the change, and we'll tell you about changes affecting reminders you've already set up.
5. If something goes wrong
- If we can't produce or mail a card, you won't be charged for it, or we'll refund it.
- If a card is returned as undeliverable, you can correct the address and we'll send it again once, free.
- If a card arrives damaged or isn't what you ordered, contact us within 30 days and we'll replace or refund it.
- Otherwise, because each card is made and mailed for you, cards that have been sent can't be refunded.
6. What you may send
You're responsible for your cards' content and recipients. Don't use the service to send anything:
- unlawful, threatening, harassing, hateful, defamatory, obscene or fraudulent;
- to someone who has asked not to hear from you, or whose address you don't have a right to use;
- that you don't have the right to use, such as photos or text that belong to someone else;
- in bulk or for marketing (Send a Smile is for personal cards).
We may decline to send a card, and may suspend or close an account, if we reasonably believe these terms are being broken. If we decline a card, you won't be charged for it.
7. Your content
You keep ownership of the photos, messages and other content you add. You give us permission to store, print, reproduce and mail it as needed to provide the service to you, and to show it back to you in the service. You confirm you have the right to give us that permission.
8. Designs and artists
Card designs in our library, including those by independent artists, are licensed to you only for cards you send through the service. Cards with an artist's design carry a small credit and QR code on the back, and part of the price goes to the artist. Don't copy designs or use them outside the service.
9. The writing assistant
"Help me write it" suggests messages using an AI service. Suggestions are a starting point: read and edit them before you send, because you're responsible for the message on your card.
10. Contacts you import
If you import contacts from your phone, Google or Outlook, you confirm you're allowed to use them to send cards, and you'll keep them only for that. See our Privacy Policy for how we handle them.
11. The service
We work to keep Send a Smile running well, but it may sometimes be unavailable, and we may change or end features. If we end the service, we'll give you notice and refund anything paid for cards we haven't sent.
12. Disclaimers and limits
Except as stated in these terms, the service is provided "as is", without warranties of any kind, to the extent the law allows. To the extent the law allows, we aren't liable for indirect or consequential losses, or for delays or losses caused by the postal service, and our total liability for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these terms limits rights you have under consumer protection law that can't be limited.
13. Changes to these terms
We'll post any change here and update the date above. If a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using the service afterwards, the new terms apply.
14. Law and disputes
These terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws rules. If there's a problem, please contact us first; most things can be fixed quickly.
